Abstract

Errors in treatment due to insufficient management of hygiene processes, for example handling of MRSA, can cause liability for consequences. The legal principles to handle MRSA result particularly from the so called Infection Protection Act (IfSG). Terms of reference, guidelines and recommendations can provide important support to avoid liability suits. The German health care policy was as well engaged in the problem of MRSA expansion. The judicature confirms that care providers are obliged to contain the risks of avoidable infections by taking organisational und technical precautions.
